1. About these terms
These terms apply to the Cjay Analytica platform (the hosted document and finance manager) and the website www.cjayanalytica.com, provided by Cjay Analytica (business registration BN-93S9R5A6, Kenya). By creating an account or using the platform, the business you represent (the “customer”) agrees to them. A separate written agreement or quotation with the customer takes priority where it differs.
2. The service
The platform lets a customer create and manage quotations, invoices, receipts, statements, expenses and financial reports, branded as the customer’s own, and optionally connect Google and email services. We may improve and change features over time; we will not remove a core feature a customer relies on without reasonable notice.
3. Accounts
- The customer’s owner or administrators decide who has access and are responsible for what their users do.
- Users must keep their passwords private and tell us promptly about any unauthorised use.
- Accounts we create carry a temporary password that must be changed at first sign-in.
4. Customer data
Records the customer enters belong to the customer. We use them only to provide the service, as described in our Privacy Policy. The customer is responsible for having the right to store the personal data it enters about its own clients and staff, and for its accuracy. On request, and when an account ends, we will help the customer export its records.
5. Google and other connected services
If the customer connects Google or an email account, those services are provided by their own providers under their own terms. The customer can disconnect them at any time. We are not responsible for outages or changes in those third-party services.
6. Support access
During set-up our support staff may open the customer’s company to configure it. After go-live they only do so with the approval of the customer’s owner or an administrator, for the period approved.
7. Acceptable use
The customer will not use the platform to break the law, send spam or misleading documents, upload malicious code, try to access another customer’s data, or interfere with the service. We may suspend an account that does, after notice where practical.
8. Fees
Fees, plans and any free trial are as quoted to the customer or shown when it signs up. Unpaid fees may lead to suspension after reasonable notice. Fees exclude taxes unless stated.
9. Availability
We aim to keep the platform available at all times but do not guarantee uninterrupted service. Planned maintenance will be scheduled to limit disruption where possible.
10. Liability
The platform is provided on an “as is” basis. The customer remains responsible for checking documents and figures before sending them or relying on them, including tax and accounting figures. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability in any 12 months is limited to the fees the customer paid us in that period.
11. Ending the service
The customer can stop using the platform at any time. Either side may end the service on 30 days’ written notice, or immediately for a serious breach that is not fixed within 14 days of notice. We delete the customer’s records within 90 days after the account ends, after offering an export.
12. Governing law
These terms are governed by the laws of Kenya. We will first try to resolve any dispute by discussion; if that fails, the courts of Kenya have jurisdiction.
